What CA Employers and HR need to know for 2023 and 2024

Here are some helpful reminders and sneak peaks of what's to come in 2024 and beyond.


Rules don't always wait until the new year to roll out. So, we've put together some information to help you close out 2023 and prepare for 2024 and beyond.


NEW Min Wage: On January 1, 2024, the minimum wage in CA will go to $16.00/hr. and $66,560 for exempt. Currently, it's $15.50/hr. and minimum for exempt salary is $64,480.

UPDATED I-9 Requirements: The employment eligibility verification process has been updated which includes a new I-9 that must be used as of November 1, 2023. For e remote I-9 verifications, you may continue to do so only if you use E-Verify. To enroll in E-Verify, go to: Enroll

Off Duty Cannabis Use Protections: Beginning January 1, 2024 CA employers will be prohibited from discharging employees or refusing to hire individuals based on their off-duty use of cannabis. AB 2188 amends CA Fair Employment and Housing (FEHA) to prohibit discrimination against an individual based on "an employer-required drug screening test" that detects the presence of "nonpsychoactive cannabis metabolites in their hair, blood, urine, or other bodily fluids." There are some exceptions and other conditions.

EEO-1: For employers with 100+ employees, collection for your EEO-1 for 2022 will begin on October 31 thru December 5. For more information on this go to: EEO1

Retirement Plans: In CA if you have five or more employees, you must have a retirement plan in place. By 2025, all CA employers with at least one employee will be required to have a retirement plan in place, or be subject to penalties. In 2024, there are number of changes in the Secure Act 2.0 that impact all plans.

2024 Employment Posters: If you need new employment posters for 2024, we will send out a request to our clients in the coming weeks. There are digital, paper and/or laminated options in multiple languages. They are normally released near the end of the year to ensure all new laws are captured.
